Barracuda Warranty

YOUR BARRACUDA PRODUCT IS COVERED BY A FIVE (5) YEAR LIMITED WARRANTY. 

QUALITY ASSURANCE

Barracuda products are always performance tested, as newly defined by our innovative, breakthrough products, and so tested at full capacity using stringent quality control standards, and rigorous tests of strength, durability and dependability that represent the environmental demands of the modern traveler.

PRODUCTS COVERED BY THIS LIMITED WARRANTY

This limited warranty extends to Products manufactured by Barracuda, and purchased directly from Barracuda or Barracuda’s authorized retailers (the “Products”).  Some parts of this limited warranty also extend to the battery and proximity/location sensor option sold with Products (“Electronics”).  Barracuda Products are designed for use for travel by air, auto, train, boat, and foot.  This warranty does not cover your Product if you use it in a manner incompatible with that intended design.

WHO THIS WARRANTY EXTENDS TO

This limited warranty extends to the original purchaser of any Product.  All Barracuda warranties, including any implied warranties, are valid only for the period of time the Product is owned by the original purchaser of the Product.  The “original purchaser”, for the purposes of this warranty, is the first purchaser of the Product from Barracuda or a Barracuda authorized retailer.  PLEASE RETAIN A COPY OF YOUR RECEIPT AS PROOF OF PURCHASE.  All Barracuda limited warranties are not transferable.

BARRACUDA’S LIMITED WARRANTY AND RESPONSIBILITIES

Barracuda warrants the Product in its original packaging sold to you against the defects in material workmanship set forth below (“Defects”), when the Product is used normally for intended purposes.

THIS FIVE (5) YEAR LIMITED WARRANTY DOES NOT COVER:

  • Scratches, dents, or stains that are normal during the handling of the Product and do not impair the functionality of the Product;
  • Defects caused ordinary wear and tear (i.e.: exhausted zippers), by accident, neglect, abuse, misuse, misapplication or non-Barracuda products;
  • Damage caused by handling by third parties (i.e.: airlines, hotels, etc.);
  • Replacement of any non-defective pieces in the Barracuda Product system (for example: If you purchased your Product with multiple components and only one component is defective, then we will only replace the defective component);
  • Any Product (whether manufactured by Barracuda or not) sold by resellers who are not authorized retailers;
  • Products sold “as-is”, “preconditioned”, “reconditioned”, “used”, “comfort return”, “returned”, “previously owned”, or any other similar wording indicating that the Product is not “new” or of “first quality”, or has previously been purchased or used by another consumer;
  • Damage to laptop tray or mechanism resulting from abuse or weight pressure exceeding 7.7 lbs., 3.5kgs;
  • Losing functionality of the Battery, which is covered by the Electronics One Year Warranty.
  • Losing functionality of the proximity/location sensor option, which is covered by the Electronics One Year Warranty.

In the event of a Defect, Barracuda’s sole and exclusive liability and your sole remedy under this limited warranty will be, at Barracuda’s option, to provide a repaired or replacement Product, subject to your fulfillment of “Your Responsibilities” below.  Replacement Product may be provided in a color different from the Product you originally purchased.

YOUR RESPONSIBILITIES

In the event of a Defect and in order to get the benefit of this limited warranty, you must return your Product to Barracuda and provide Barracuda with proof of the original date of purchase.  Should shipping costs be required to return your Product, you will be responsible for these costs.   Evidence of a Defect and any claims must be sent to the address set forth at the end of this limited warranty.  If you wish to replace your Product, with a more expensive product (and “Upgrade Product”), then please e-mail Barracuda at delight@barracuda.co.  You will be required to pay the difference between the original purchase price of the Product and that of the Upgrade Product, plus the cost of any related additional system pieces necessary for such Upgrade Product.  Barracuda will repair or replace (as applicable) and ship your Product or Upgrade Product back to you within 90 days of receiving your original Product.  You will not be responsible for any shipping costs associated with shipping replaced or repaired Product.  Replaced or repaired Product is subject to the same limited warranty as the original Product.

LAPTOP TRAY RESPONSIBILITIES

Barracuda’s 1st in the industry innovative, patent pending fold out laptop tray is designed for your enjoyment and use while traveling.  Your responsibility is to ensure to only place inanimate objects on the tray.  Ensure sufficient packed weight in your Product to prevent instability or tip over. DO NOT exceed 7.7 lbs. (3.5 kg) weight on the Laptop Tray at any time.  Do not place items on the Laptop Tray, which could damage the Laptop Tray or folding mechanism.  Do not leave items on the Laptop Tray unattended.  Ensure the Laptop Tray is fully folded and locked into place, before retracting trolley handle.  Barracuda will not be responsible for any damage resulting from use of the Laptop Tray.

DISCLAIMER, LIMITATION ON LIABILITY

To the extent permissible by applicable law, the Product is provided “as is” and this warranty and any implied warranties are your exclusive warranties and replace all other warranties or conditions, express or implied.  Some states do not allow limitations on how long an implied warranty lasts, so the above limitations may not apply to you.  Some states or other jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.  You may also have other rights that vary from state to state and jurisdiction to jurisdiction.

To the maximum extent permitted by applicable law and except as set forth in this limited warranty, in no event will Barracuda or its suppliers be liable for procurement of substitute products or other special, incidental, consequential or indirect damages arising out of or related to the Product or its use by you or any third party, whether under theory of contract, tort (including negligence), indemnity, product liability or otherwise.  This limitation will apply even if Barracuda has been advised of such damages and notwithstanding the failure of essential purpose of any limited remedy Barracuda’s total liability will not exceed the purchase price paid for the Product giving rise to such liability.  Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you.

Barracuda reserves the right to deny repairs for a returned item that does not comply with this policy. In such cases, the customer will be responsible for return shipping costs.

ARBITRATION

In the event a dispute arises between you and Barracuda arising out of this Limited Warranty, such dispute will be determined and settled by binding arbitration between the parties, in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”).  More information about the AAA is located at www.adr.org, or you can call the AAA at 1-800-778-8979.

You must seek arbitration for disputes arising out of this Limited Warranty prior to exercising any rights or seeking any remedies created by Title I of the Magnuson Moss Warranty Act.  If you choose to pursue any rights and remedies that are not created by Title I of the Magnuson Moss Warranty Act, then arbitration is not required.  Arbitration will take place in San Francisco, California.

This arbitration will not be combined with any other proceeding or arbitration against one of the parties.  Each party will designate one arbitrator and the two designated arbitrators will select a third arbitrator, who will serve as the chair of the arbitrator panel.  If the two arbitrators cannot agree on the third arbitrator, then the AAA will appoint the third arbitrator.  Barring extraordinary circumstances, the arbitrators will issue their decision within 120 days from the date the third arbitrator is selected by the two designated arbitrators or appointed by the AAA. The arbitrators may extend this time limit for an additional 30 days in the interests of justice.  All arbitration proceedings will be closed to the public and confidential and all related records will be permanently sealed, except as necessary to obtain court confirmation of the arbitration award.  The decision and the arbitrators’ award will be in writing and will include a statement setting forth the reasons for the disposition of any claim.  A dissenting decision will also be set forth in writing.  The arbitrators’ award will be final and binding on the parties, and judgment thereon may be entered in any court of competent jurisdiction.

GOVERNING LAW

This limited warranty will be governed by the laws of the State of California.

BARRACUDA ELECTRONICS ONE YEAR LIMITED WARRANTY

The Electronics in your Barracuda product is covered by a ONE YEAR limited warranty.  This limited warranty gives you specific rights, and you may also have other rights, which vary from state to state.

PRODUCTS COVERED BY THIS LIMITED WARRANTY

This limited warranty extends to batteries and luggage locator option produced by Barracuda and purchased directly from Barracuda or Barracuda’s authorized retailers (the “Electronics”).  The Electronics are designed to be used in the Product for travel by air, car, train, boat and foot.  This Warranty does not cover your Electronics if you use in them a manner incompatible with that intended design.

WHO THIS WARRANTY EXTENDS TO

This limited warranty extends to the original purchaser of any Electronic (combined within the Product).  All Barracuda warranties, including implied warranties, are valid only for the period of time the Electronics are owned by the original purchaser of the Product.  The “original purchaser”, for the purposes of this warranty, is the first purchaser of the Product from Barracuda or a Barracuda authorized retailer. PLEASE RETAIN A COPY OF YOUR RECEIPT AS PROOF OF PURCHASE.  All Barracuda limited warranties as not transferable.

BARRACUDA LIMITED WARRANTY AND RESPONSIBILITIES

Barracuda warrants the Electronics in its original Product and packaging sold to you against the defects in material and workmanship set forth below (“Defects”) for a period of one year from the time your Product is purchased by you, when the Electronics and Product are used normally for their intended purposes.

WHAT THIS LIMITED WARRANTY COVERS

The Limited Warranty applied to the following Defects:

  • The Battery no longer holding a charge
  • The Battery no longer charging compatible devices
  • For Terms & Conditions for the proximity/location sensor option, visit https://lugloc.com/terms

The Limited Warranty does not cover the following:

  • Perceived “slowness” of charging
  • Battery functionality if Battery is charged using a cord that is not provided by Barracuda
  • Battery functionality if Product if abused beyond the normal wear and tear expected of the Product’s intended use.

In the event of a Defect, Barracuda’s sole and exclusive liability and your sole remedy under this limited warranty will be, at Barracuda’s option, to provide a repaired or replaced Electronics, subject to your fulfillment of “Your Responsibilities” below.  Replacement Electronics may be provided in a color different from the Electronics originally provided with your Product purchase.

YOUR RESPONSIBILITIES

In the event of a Defect, and in order to get the benefit of this limited warranty, you must return your Electronics to Barracuda and provide Barracuda with proof of the original date of purchase.  Should shipping costs be required to return your Electronics, you will not be responsible for these costs.  Evidence of a Defect and any claims must be sent to the address set forth at the end of this limited warranty.

Barracuda will repair or replace (as applicable) and ship your Electronics to you within 90 days of receiving your original Electronics.  You will not be responsible for the shipping costs associated with shipping a replaced or repaired Electronics.  Replaced or repaired Electronics are subject to the same limited warranty as the original Electronics.  For example, if you obtain a replaced or repaired Electronics, then the warranty term of the replaced or repaired Electronics begins from the date of the original Electronics/Product.

NATIONAL OR REGIONAL STATUTORY RIGHTS

Consumers in some jurisdictions may have legal rights under applicable national legislation in the sale of consumer goods, including without limitation, national laws implementing EC Directive 99/44.  These rights are not affected by the warranties in this Limited Warranty.  In all other aspects, the terms of this Limited Warranty shall apply.
